Witness & Ombudsman Guidance
Requirements depend on the document and care setting. A notary and a document witness do not necessarily serve the same function.
Hospitals, Hospice & Skilled Nursing
- Hospital or hospice: Confirm the specific document's witnessing and execution requirements.
- Skilled nursing facility: An advance health care directive requires a designated patient advocate or ombudsman to serve as a witness under California Probate Code § 4675.
- Other documents: Powers of attorney and affidavits may follow different execution rules.
Important: An ombudsman is not automatically required for every hospital or hospice notarization. We can help identify questions to ask, but cannot provide legal advice or arrange an ombudsman without separate coordination.
Signature by Mark
When a signer cannot write a conventional signature, California permits certain documents to be signed by a mark, provided the applicable requirements are met.
- The signer personally makes the mark and must understand and willingly participate.
- Two witnesses observe the mark and sign their names as witnesses.
- One witness writes the signer's name next to the mark.
- The journal mark has its own witnessing procedure.
- The notary completes the applicable notarial act and journal entry.
The signer must personally appear and meet identification and other legal requirements. A signature by mark does not allow someone else to sign in the signer's place.

Do I need an appointment?
Appointments are recommended so we can confirm availability. Mobile and facility visits require advance coordination.
Can you notarize documents for someone in a hospital?
Potentially, if the signer can personally appear before the notary, meets identification and other legal requirements, and can communicate willingness. Witness or ombudsman requirements may also apply depending on the document and care setting.
Does a signature by mark require two witnesses?
For the California signature-by-mark procedure, two witnesses observe the signer making the mark and sign the document as witnesses. The notary journal has a separate witness procedure.
Are you approved to provide services at Otay Mesa ICE?
Curlypri reports having received approval to provide professional officiant and notary services there. Each visit must still be coordinated and approved under the facility's current procedures.
Can the notary choose the form of notarization for me?
No. California notaries cannot provide legal advice or choose the notarial act for a client. Please ask the document recipient or a qualified legal professional if the required act is unclear.
